TERMS OF SALE VIA THE ROSALIQUE INTERNET STORE
- GENERAL PROVISIONS OF TERMS OF SALE
The holder of all rights to the website rosalique.hr is the company RONDO MONDO d.o.o. (hereinafter referred to as: Rondo Mondo). Rondo Mondo provides sales services through its service – Rosalique online store (hereinafter referred to as: Rosalique) via the aforementioned site. By using the Rosalique service and all associated sites and services on the rosalique.hr domain, consumers are deemed to be familiar with these Terms of Sale (hereinafter referred to as: Terms) at all times, and to fully understand and accept them. These Terms apply to the rights and obligations relating to the purchase of products or services through Rosalique, and the rights and obligations arising from the conclusion of a Distance Selling Agreement (hereinafter referred to as: Agreement) between the consumer as the end customer and Rosalique, and are considered an integral part of such agreements.

The use and enjoyment of Rosalique by children or minors is not permitted, and parents and/or guardians are required to take this into account, otherwise they assume all rights and obligations arising from such use, and Rondo Mondo is not responsible for any consequences of such use.
Purchased products are used at your own risk and cannot be considered a substitute for medical or nutritional therapy.
Rosalique fully disclaims any responsibility for the accuracy and/or completeness of all information and content found on rosalique.hr. Rosalique reserves the right to errors in product descriptions and images.
Rosalique does not guarantee that product photos fully correspond to the appearance of the product itself. We are not responsible for possible unintentional errors in product descriptions. There may be differences between the actual product and the product photos and the product described on these pages, if the manufacturer changes any of the product characteristics or content. - TERMS OF SALE
- I) Conclusion and termination of sales contracts
These Terms and Conditions, as well as certain terms of sale indicated with information about certain products, represent an offer by Rondo Monda for the conclusion of a Contract, and the user, as the buyer, accepts them by registering, concluding an order, or in another manner determined by these Terms, which is considered to be the conclusion of a Contract between the user and Rondo Monda, according to the terms of sale specified in these Terms.
The subject and commercial purpose of the Agreement is the purchase of a selected product or service through Rosalique upon payment of the appropriate fee - the price of that product or service. The contract is concluded by means of remote communication (Contract concluded at a distance) through: printed advertising messages with purchase order, telephone with and without human intervention, and the Internet.
The contract enters into force and is binding from the moment the user accepts the Rondo Monda offer in one of the following ways:
- by selecting payment and completing the order as a registered user of Rosalique
• by selecting payment and completing the order via 01/8877-615
- a) In the process of registering or creating a user account, the user is obliged to choose a name or alias under which they will use the services and choose a security password and provide a valid e-mail address. All data required for registration or creating a user account must be true, and the use or exploitation of other people's data is expressly prohibited.
- b) Registration or user account is created for one person only and it is not permitted to communicate registration or user account information to third parties. The user is obliged to keep his/her security password and user account information confidential. It is not permitted to use someone else's registration or user account.
- c) For violation of the provisions of the Terms and Conditions from this chapter, Rondo Mondo reserves the right, at its discretion, to terminate the user's registration or user account, without the obligation to compensate the user for any cost or damage.
- d) Registration (which includes payment for the service) is considered to have concluded a Contract between Rondo Mondo and the user as a customer.
- e) The Agreement enters into force upon the user's registration, i.e. from the day the user accepts the offer to enter into such an Agreement.
- f) Upon conclusion of the Contract, the User will be provided with: a confirmation of the concluded Contract, i.e. a pre-contractual notice referred to in Article 57, paragraph 1 of the Consumer Protection Act (Official Gazette, No. 41/2014), these Terms and Conditions, and a notice regarding the User's right to unilaterally terminate the Contract with a form for unilateral termination of the Contract referred to in Article 61, paragraphs 1 and 2 of the Consumer Protection Act.
- g) The User may unilaterally terminate the Agreement within 14 (fourteen) days without giving any reason. The User does not have the right to unilaterally terminate the Agreement:
- if the service has been fully fulfilled for him, and the fulfillment began with his explicit prior consent and with his confirmation that he is aware of the fact that he will lose the right to unilaterally terminate the Agreement if the service is fully fulfilled for him,
– if the subject of the Contract is sealed goods that are not suitable for return due to health or hygiene reasons, if they were unsealed after delivery,
– if the subject of the Contract is goods which, due to their nature, are inseparably mixed with other things after delivery,
In order for the user to exercise the right to unilaterally terminate the Agreement, he must inform Rondo Mondo of his decision to unilaterally terminate the Agreement before the expiry of the deadline by an unambiguous statement sent by post (to RONDO MONDO d.o.o., Zagrebačka cesta 212, 10000 Zagreb), by fax at 01/8877-608 or by e-mail at [email protected] , in which you will state your name and surname, address, telephone number, fax number or e-mail address, and you may also use the specified written form for unilateral termination of the Agreement.
Also, the user can electronically complete and send the Form for Unilateral Termination of the Contract, in which case Rondo Mondo will promptly send him/her a confirmation of receipt of the notification of unilateral termination of the Contract by e-mail.
The deadline for unilateral termination of the Contract is 14 (fourteen) days from the day on which the goods that are the subject of the Contract are delivered to the user or a third party designated by the user, who is not the carrier, or in the case of a service, from the conclusion of the Contract.
If the user unilaterally terminates the Contract, the money received from him, including delivery costs, will be refunded to him without delay, and at the latest within 14 (fourteen) days from the day on which Rondo Mondo, or Rosalique, receives the user's decision to unilaterally terminate the Contract, unless the user has chosen another type of delivery, which is not the cheapest standard delivery offered. The refund will be made in the same way as the user made the payment. In the event that the user agrees to a different method of refund of the paid amount, he does not bear any costs in relation to the refund. Rondo Mondo can only refund the money after the goods have been returned to him or after he has been provided with proof that the goods have been sent back.
The User is obliged to hand over the goods or send them to the address RONDO MONDO d.o.o., Zagrebačka cesta 212, 10000 Zagreb, without undue delay, and in any case no later than 14 (fourteen) days from the date on which he/she sent his/her decision to unilaterally terminate the Contract to Rondo Mondo, or Rosalique. The User must bear the direct costs of returning the goods themselves. The User is requested to call 01/8877-626 or contact [email protected] before terminating the Contract so that the procedure for returning the goods can be explained to him/her.
The user is responsible for any decrease in the value of the goods resulting from the handling of the goods, except for that which was necessary to determine the nature, characteristics and functionality of the goods.
If, at the user's request, the performance of the service has begun during the period for unilateral termination of the Agreement, the user is obliged to pay Rondo Mondo an amount proportional to what was delivered up to the moment the user notified Rondo Mondo of the unilateral termination of the Agreement.

- II) Terms and purchase procedure
The main product characteristics, instructions for use, prices, special offers and benefits, payment and delivery methods refer to those valid at the time of the order. The above information will be indicated with each product.
The price of the product, including VAT and delivery costs, is visible in the shopping cart before the order is completed. The delivery cost may also be visible in some other parts of the site. All information about the purchase confirmation based on an electronic order will be delivered to the customer's email address specified in the registration/order process or in the shopping cart when entering data when completing the order. All prices are expressed in Croatian kuna (HRK). All prices include VAT.
If the customer does not receive an order confirmation notification, there is a possibility that they have entered their email address incorrectly. III) Delivery and delivery terms
- The shipping cost is calculated automatically when purchasing a product and you will be issued an invoice that includes the price of the purchased products and the shipping cost.

• the delivery period for products, which are stated to be in stock, throughout Croatia is 10-14 days from the day of the order, except for products with a special note
• in the case of application of the delivery deadline or any other important circumstances for the execution of the order, the customer will be informed immediately by our customer service
- IV) Complaints and objections
The ordered products are packed in such a way that they are not damaged by normal handling during transport/delivery. The buyer is obliged to inspect the packaging of the shipment when taking it over. If the packaging of the shipment has visible damage/flaws, we recommend that the customer refuse to accept it, as there is a possibility that the product inside such packaging is damaged. By rejecting the receipt, the delivery service will return the shipment to Rondo Mondo, noting that the shipment contains a defect.

In the case of a justified complaint, it is possible to terminate the contract with a refund of the amount paid or product replacement. If it is a question of damage and/or malfunction of the delivered goods, the buyer should send a photo of the said complaint so that it can be accepted on the basis of physical evidence. Rosalique collects the claimed damaged, defective or wrongly delivered goods at its own expense, if it is determined that the claim is justified and that the buyer has not affected the defect, damage or any lack of the goods. In the event of a justified complaint, the cost of replacing the product with a new one is entirely borne by Rosalique.
In the event of a dispute regarding the justification of the complaint and/or the manner in which the product was returned (the product must be unused, in unchanged quantity and in its original packaging, with the original invoice and warranty, if any, presented), the product will be submitted for expert assessment to an expert or a professional legal entity. If the expert assessment determines that the complaint is justified, all costs of replacing the product will be borne by Rosalique, and in the case of an unjustified complaint, the costs will be borne by the buyer.
- V) Warranty for the correctness of the sold products and service
Products for which we provide a warranty in accordance with the law and the warranty specified by the manufacturer have a warranty certificate. The right to use the warranty is exercised upon presentation of the invoice and warranty certificate. The buyer is obliged to keep the warranty certificate and invoice. The date of issue of the invoice is the date of commencement of the warranty. The product description includes information on the period for which the warranty is provided for a specific product.
In the case of issuing a warranty certificate by which the manufacturer guarantees the correctness of the product for a certain period of time, the buyer may, if the product is not correct, request that the product be repaired within a reasonable time, or that another such correct product be delivered to him instead of repair. If a product malfunction occurs during the warranty period, the product shall be delivered to the authorized service specified in the warranty certificate.
The right to use the warranty is exercised exclusively upon presentation of the invoice. The buyer is obliged to keep the warranty card and invoice. Product malfunctions resulting from improper use and/or failure to comply with the instructions are not covered by the warranty. Servicing and sale of replacement parts for the purchased product are provided through authorized service centers listed in the warranty card.
The warranty does not exclude the merchant's liability for material defects in the product.
The deadline for complaints in case of material product defects is 2 years.
- VI) Payment method and procedure
Payment for the product price and delivery costs can be made in one of the following ways:
- a) Payment by proforma invoice (only for legal entities). Legal entities have the option of paying by proforma invoice. After confirming the order, Rosaliquea sends a proforma invoice to the customer's email address. After receiving the payment in accordance with the proforma invoice, the delivery process is initiated.
- b) Payment in cash - on delivery. When picking up the shipment, the entire amount indicated on the invoice, including the delivery cost, is paid to the delivery person.
- DATA PROTECTION WHEN PURCHASING
Rosalique undertakes to respect the anonymity and privacy of Rosalique users and will use and process the data solely for the purpose and purpose specified in these Terms. Rosalique may collect personal data of users, such as name, address, OIB, telephone number or e-mail address, only if the user voluntarily provides it to Rosalique.
Rosalique will use the aforementioned data solely for the purpose of fulfilling contractual obligations and for better insight and understanding of the individual needs, habits and requirements of users, as well as for further development and better provision of all Rosalique services. Rosalique collects, processes and publishes data about users relating to the use of Rosalique without revealing the identity of the user and/or personal data that enable the identification of the user.
Rosalique collects and records data about the user's IP address (Internet Protocol Address) or about the location of the computer for the purposes of system administration, troubleshooting, content download confirmation, or improving the technical aspects of the Internet service. Rosalique will automatically record data on the user's usage habits of Rosalique, including a log file on visits to certain pages and/or content. Such data will be used by Rosalique exclusively for the purpose of improving its service and adapting and individualizing promotional activities according to the needs of individual users.
- ROSALIQUE'S COMMUNICATION WITH USERS
By registering, you agree that Rosalique may, for the purpose of promoting services and products, notify you via email about changes or additions to content on the site, discounts, promotions, products, or changes in the way the service is provided. The user may revoke the aforementioned consent at any time.
